Privacy policy

Your information deserves care.

Last updated: October 16, 2026

This Privacy Policy explains how Oseland | McNabb collects, uses and shares information connected with our website, and how you can contact us about your privacy. You can browse properties without creating an account. Providing information for an inquiry and choosing email updates are separate decisions.

1. Who we are and what this policy covers

“Oseland | McNabb,” “we,” “us” and “our” refer to the real estate team of Alexandria Oseland and Keith McNabb with The Agency Sun Valley, located at 100 4th Ave Suite 1B, Ketchum, ID 83340. This policy covers oselandmcnabb.com, its website forms, property search, and communications arising from those requests.

It does not replace a brokerage agreement, transaction disclosure or privacy notice provided by a lender, title company, MLS or another independently operated service. If you become a client, additional information and records may be needed for your transaction. A website inquiry by itself does not establish an agency relationship.

2. Information we collect

Information you choose to provide

  • Contact details: your name, email address and optional telephone number.
  • Real estate interests: whether you are buying or selling, an address you provide, budget or expected price range, timing, preferred areas, bedroom count, property type, showing preferences and the contents of your message. A home-base shortlist request also includes the activity and setting preferences you selected.
  • Property inquiries: the listing reference and publicly displayable address associated with the property you ask about.
  • Communication choices: whether you request email updates or a personal call, the request wording, wording version and recorded time, and later unsubscribe or contact preferences.
  • Correspondence: information you send when you email, call or ask us to handle a privacy request, together with relevant follow-up records.

Required fields are marked on each form. Newsletter signup requires your email address and an affirmative request for updates. The home-base shortlist form requires your email address and keeps your name optional. It collects a phone number only if you request a call and agree to the separate call wording. Other inquiry forms require your name and email, with telephone numbers optional. You may contact us directly instead of using a form.

Information processed when you use the website

Website delivery and security involve technical information such as your IP address, browser and device characteristics, requested pages and URLs, request times, and security checks. Property searches include the search terms and filters you select. Search criteria can appear in the address bar, browser history and website request records.

When you submit a form, we also receive its category, the page it came from, the referring website’s origin when available, campaign source/medium/name parameters when present, the submission time and a randomly generated submission reference. A home-base shortlist request can also include campaign content and search-term parameters, and advertising click identifiers present in the link you used to reach the experience. These help us identify which campaign brought an inquiry. The form does not send the referring page’s complete path or query string to Rechat.

Information these forms are not designed to collect

Please do not submit Social Security numbers, identity documents, payment-card or bank details, account passwords, health records or wire instructions through website forms. If sensitive documents become necessary for a transaction, ask us for the appropriate delivery method. We do not request access to your device’s precise location through the property search.

3. How we use information

We use information for the following purposes:

  • Answer questions, discuss your real estate needs and follow up on an inquiry.
  • Coordinate requested consultations, property information and showing arrangements.
  • Display properties matching your search and provide the map view you select.
  • Maintain contact records and organize inquiries by their source and purpose.
  • Record and honor communication choices, including requests for email updates.
  • Operate the website, troubleshoot delivery problems and prevent spam or abuse.
  • Meet applicable recordkeeping duties, respond to lawful requests and resolve disputes.

Inquiry labels help us organize follow-up. The website does not use those labels to make automated decisions about credit, financing or eligibility to purchase a home.

4. Inquiries and Rechat

Rechat is our client relationship management service. When online delivery is available, website inquiries and newsletter requests pass through our server’s validation and spam checks before being submitted to our team’s Rechat lead channel. The record contains the contact information and inquiry details you submit, relevant property or search context, source information, and your email-update preference.

We attach labels such as buyer inquiry, seller inquiry, property inquiry or newsletter request so our team can follow up appropriately. A record may be associated with an existing contact, depending on the information provided and how the contact is managed in Rechat. Submission does not create a public profile or post your message on the website.

Viewing a home-base result or search brief does not create a Rechat contact. If you submit a personal shortlist request, the submitted contact details, selected preferences, communication choices and available campaign context are sent together so our team can review current options and respond personally. This request does not create an automatic saved search or listing-alert subscription.

The website does not automatically send every property you browse or every search you run to your Rechat contact record. Search preferences become part of an inquiry when they are included in the form you submit. The website’s lead integration does not send your browser’s IP address or its security-verification token as contact fields to Rechat.

If the website cannot confirm delivery, it will tell you. Please contact us directly rather than assuming an inquiry was received. More information about the service is available inRechat’s privacy policy.

5. Email, telephone and communication choices

Sending an inquiry allows us to use the details you provide to respond to that request. It does not automatically enroll you in a newsletter or authorize automated marketing calls or text messages. The optional email-update checkbox on an inquiry form is separate from submitting the inquiry; newsletter signup requires its own affirmative selection.

The home-base form offers a separate choice to request a personal call about your search. Its phone field appears only when you select that choice, and the form requires your call agreement before submitting the number. This does not authorize marketing texts or automated calls.

You can stop our marketing emails using the unsubscribe link in an email or by contactinghomes@oselandmcnabb.com. We will honor marketing-email opt-out requests within ten business days, without a fee. An email unsubscribe does not require identity documents or information beyond what is needed to identify the email address. We may retain a limited suppression record to avoid sending unwanted marketing later.

An inquiry without an email-update request does not reverse a previous unsubscribe. Marketing opt-out does not prevent communications necessary to carry out a transaction you have requested or provide a legally required notice. We will not use that distinction to send promotional messages after you unsubscribe.

This website does not enroll you in an automated SMS campaign. If you provide a telephone number, you may tell us how you prefer to be contacted or ask us to stop nonessential follow-up. Any future text-message subscription would require a separate, clearly described signup process. We do not share telephone numbers or text-message consent with third parties for their own marketing.

6. MLS searches, maps and property alerts

Listing searches

Listings are supplied through Spark Platform and the Sun Valley Board of Realtors MLS. Our server sends the listing provider the search criteria or listing identifier needed to retrieve results, details and photographs. The listing-search integration does not send your inquiry’s name, email address or telephone number to the MLS feed. Your contact information is handled separately when you submit an inquiry.

FBS, the provider of Spark Platform, processes the requests our server makes to its service and associated technical usage information. Its handling of information is described in the FBS privacy policy. Use of the listing service is also subject to the Spark Consumer Terms of Use.

Map view

When you select map view, your browser requests map images from OpenStreetMap’s map service. That service receives technical information such as your IP address, browser information, our website’s origin and the map tiles requested, which indicate the area being viewed. Our map does not request GPS or device-location permission. You can use list view without loading the map. See the OpenStreetMap Foundation privacy policy for its processing practices.

Saved searches and alerts

Automated saved searches and listing-alert subscriptions are not currently available on this website. Sending search preferences to our team does not create an alert subscription. If we introduce that feature, its signup process will explain which criteria and account details are stored, who provides the alerts, and how to manage or cancel them. We will update this policy as needed before the feature begins collecting information.

7. Cookies, browser storage and tracking

The website does not currently include advertising pixels, behavioral advertising, cross-site audience tracking or third-party audience-analytics scripts. Its own code does not store a marketing identifier in cookies or browser local storage. The home-base experience uses browser session storage for campaign parameters, advertising click identifiers present in your landing link and the referring website’s origin, so a later shortlist request can retain that campaign context. If you submit the request, this context is included with the inquiry in Rechat. Session storage is optional; the form can work without it.

Search criteria can be carried in the page URL. Generated home-base result and brief links contain search preferences rather than the name, email address, phone number or message entered in the contact form. A form submission receives a random reference.

Cloudflare provides hosting, network security and Turnstile spam protection. Turnstile processes security signals, including IP address and browser characteristics, to distinguish visitors from automated traffic. Our server also uses an IP address to limit excessive requests and verify form submissions. Cloudflare may process information for its own security purposes as described in its privacy policy and Turnstile Privacy Addendum.

Your browser and service providers may use caching, security cookies or other technical storage needed to deliver and protect their services. Browser controls let you limit cookies, scripts and stored data; doing so can affect forms, maps or security checks. You can contact us by email or telephone if a feature is unavailable.

We do not currently sell personal information collected through this website or share it for cross-context behavioral advertising. There is therefore no such sale or advertising sharing to disable when we receive a Global Privacy Control signal. The site does not otherwise alter its necessary hosting or security processing in response to a browser’s Do Not Track setting. We will honor any applicable legal requirements for privacy signals if our practices change.

8. When we share information

Information may be disclosed to the following recipients for the purposes described here:

  • Our team and brokerage: Alexandria Oseland, Keith McNabb, and authorized brokerage personnel who need information for follow-up, supervision, support or records.
  • Service providers: Rechat, Cloudflare, email providers and technical support providers as needed to operate the website and handle communications. Listing and map providers receive the information described in Section 6.
  • People involved in a requested service: for example, a listing agent coordinating a showing, or transaction professionals when you ask us to coordinate with them or disclosure is needed and permitted to carry out your instructions.
  • Legal and professional recipients: regulators, courts, legal advisers, insurers or others when reasonably necessary to comply with law or valid legal process, meet brokerage duties, investigate misuse, or protect legal rights and safety.

We do not rent website inquiry or newsletter lists to unrelated marketers. If responsibility for this website or our business changes, relevant records may be transferred as part of that change, subject to applicable law and the privacy commitments governing those records. A business transfer does not itself authorize new marketing uses or erase an unsubscribe.

9. How long we keep information

Retention depends on the type of record, our relationship with you and applicable obligations. We keep inquiry and correspondence records as reasonably needed to handle your request, maintain an ongoing relationship, document instructions and resolve related issues. Newsletter preference and suppression records may be kept to document your choices and prevent unwanted messages. Security and delivery records are handled according to their operational purpose and the relevant provider’s practices.

If information becomes part of a brokerage transaction file, Idaho recordkeeping duties may require longer retention. Idaho Code § 54-2049 requires specified brokerage records, including certain offer, representation, transaction and trust-account records, to be kept for three calendar years after the year of the applicable event. That requirement is not a blanket three-year retention rule for every website visitor or newsletter signup. Other legal obligations or a dispute may require particular records to be kept longer.

When information is no longer needed, we will delete it or remove identifying details, subject to required records and ordinary backup cycles. Copies in restricted backups may remain until those backups are replaced. We do not promise immediate removal from every backup or the deletion of records we must retain.

10. Privacy requests and your choices

You can ask us what personal information you have supplied, request a copy or correction, request deletion, or change how we contact you. Email homes@oselandmcnabb.com with the subject “Privacy request,” call 208-720-6830, or write to the address below. Include enough information to locate your record and tell us what you would like us to do. Please do not send sensitive identity documents in your initial request.

Before disclosing or deleting personal information, we may verify that the request concerns your record or that you are authorized to act for the person concerned. We will use verification information for that purpose. Newsletter unsubscribe requests use the simpler process in Section 5.

We will review requests and respond as required by applicable law. We may need to retain transaction records, evidence of consent or suppression, security information, or records needed to comply with law or establish legal claims. If we cannot complete a request, we will explain the relevant limitation where permitted. You can ask us to reconsider a response by replying to the same contact address.

These contact options are available regardless of where you live. Additional statutory rights, including access, correction, deletion, portability, objection, opt-out or appeal rights, depend on which law applies to you and our processing. This policy does not limit rights granted by applicable law or claim that every state’s privacy statute applies to this business. We will not penalize you for exercising an applicable privacy right.

Idaho residents may also raise consumer-protection concerns with theIdaho Attorney General’s Consumer Protection Division. Please review that office’s notice before submitting sensitive information; documents submitted to a public agency may become public records.

11. Security and Idaho breach notification

The website uses HTTPS, server-side form validation, spam verification and request limits. Integration credentials are kept on the server rather than included in public page code. These measures reduce risk, but no website, email system or storage service can guarantee complete security. Please contact us promptly if you believe information submitted through the website has been misused.

When an incident triggers Idaho’s breach-notification law, we will investigate and provide notices required by Idaho Code §§ 28-51-104 through 28-51-107 and other applicable law. Idaho’s law calls for a prompt investigation and, when the statutory misuse threshold is met, notification to affected residents as soon as possible without unreasonable delay, subject to the law’s investigation, restoration and law-enforcement provisions. The law’s specific definition of covered personal information differs from the broader information described in this policy. See Idaho Code § 28-51-105.

12. Children’s privacy

This website is intended for adults seeking real estate information and services. It is not directed to children under 13, and we do not knowingly collect their personal information. If you believe a child under 13 has submitted personal information, contact us so we can investigate and take appropriate steps to remove it.

13. External services and processing locations

Links to social media, other websites, email applications and independently operated services take you to services with their own privacy practices. Their policies govern information you provide directly to them. Linking to them does not mean that this website automatically sends them your form contents.

Our business is based in Idaho, United States. Hosting, communication and other providers may process information in the United States and other locations where they operate. Information is not necessarily stored only in Idaho. Applicable legal protections and provider practices can vary by location; contact us with questions about a particular service or request.

14. Changes to this policy

We may update this policy when our website, services or legal obligations change. The “Last updated” date identifies the current version. For material changes, we will provide additional notice when required by law and obtain consent where required before beginning a new use. An updated policy does not by itself cancel your communication choices or supply consent that is otherwise required.
